Man Driving With Open Container Of Alcohol On Route 202 Charged With DWI, Police Say

A motorist was busted driving with a blood-alcohol content more than double the legal limit with open alcohol in the car during a traffic stop near a busy Yorktown intersection.

The Yorktown Police Department received a report of a possibly intoxicated driver leaving a Downing Drive business at approximately 6:15 p.m. on Oct. 15. 

Officers were dispatched to the area and spotted the alleged driver’s vehicle on Crompond Road making an illegal lane shift, prompting a traffic stop.

During the stop, officers said that the driver, Yorktown resident Villagran, was driving while impaired. Further investigation found that he was allegedly driving with a blood alcohol content greater than .18 percent, and there was an open container inside his vehicle.

Villagran, 47, was arrested and charged with aggravated DWI with a blood alcohol content greater than .18 percent and driving while intoxicated. He was also cited for refusing to submit to a preliminary breath test, open alcohol container in a vehicle, failure to use a designated lane and failure to use a turning signal.

Following his arraignment, Villagran was released on $100 cash bail and is scheduled to appear in Yorktown Justice Court on Oct. 30 to answer the charges.
